Hughson Unified School District's Special Education Department/Special Education Local Plan Area (SELPA) ensures that appropriate programs and services are available for all students identified with disabilities under the IDEA (Individuals with Disabilities Education Act 2004). The Special Education Department supports every student's right to an individualized educational program that is reasonably calculated to provide meaningful educational benefit based on the student's identified and unique needs. Assembly Bill 1466

Pupil discipline: restraint and seclusion: Amend section 49006 of the Education Code, relating to pupil discipline.

Existing law authorizes an educational provider, as defined, to use behavioral restraints, which include physical and mechanical restraints, or seclusion, as defined, only if specified conditions are met. Existing law prohibits an educational provider from using a behavioral restraint or seclusion in certain circumstances. Existing law requires a local educational agency that meets a specified federal definition to collect and, by no later than 3 months after the end of a school year, report to the State Department of Education annually on the use of behavioral restraints and seclusion for pupils enrolled in, or served by, the local educational agency for all or part of the prior school year, as specified. This information is also required to be posted on district website.

California Department of Education

The California Department of Education (CDE) is currently engaged in litigation with two non-profit associations comprised of parents and guardians of children with disabilities.  The plaintiffs in that litigation have requested numerous documents, as well as student data collected and stored by CDE, which may include personally identifiable student information.

To comply with the Family Educational Rights and Privacy Act (FERPA), CDE has been ordered, among other things, to inform parents and students of the disclosure of such information.  CDE has requested that school districts and SELPAs post the following link to CDE’s website: http://www.cde.ca.gov/morganhillcase. The link provides a Notice and Objection Form to allow parents to object, by April 1, 2016, to the disclosure of personally identifiable information related to their children.
